Terms & Conditions

Terms applicable to all clients
  1. Participation in any tests and future exercise with Fit Around Life is voluntary, done with your consent and at your own risk.
  2. You are free to deny or withdraw consent at any time after consenting, however this will impact on our ability to provide you with our services.
  3. It is your full responsibility to inform your trainer (Elizabeth Shingleton/Fit Around Life) of any difficulties you perceive or experience as well as any changes to your physical and medical condition.
  4. Participation in any fitness programme with Fit Around Life may include both cardiovascular and muscular strength and endurance activities. It is your responsibility to inform your trainer if you do not understand specific exercises or are having any difficulties carrying out these activities.
  5. Any questions you have about the risks or benefits of exercise are welcome. If you have any reservations or doubts, please voice your concerns and ask for an explanation or clarification.
    • Potential benefits of regular exercise include: a greater feeling of wellbeing; improved confidence; improved energy; improved mobility; improved muscle tone, strength and posture; decreased risk of cardiovascular disease; improved body fat etc.
    • All activities will be risk assessed and carried out in a safe environment. They are designed to place a gradually increasing workload on the cardiovascular and muscular systems, in order to improve function. However, the body’s reaction to these physiological systems cannot always be predicted, and an outdoor environment may be more variable and challenging, meaning physical reactions cannot always be predicted with accuracy. It is ultimately your responsibility to ensure that you monitor your own condition and the environment and cease your participation (informing your trainer) if you feel that you are at risk.
  6. You recognise the exertion associated with an exercise programme and attest that you are physically fit to participate safely in the activity and that a qualified medical practitioner has not advised otherwise. You understand the demanding physical nature of this activity and have declared any medical conditions, injuries or impairments that could impact on your ability to participate in this activity.
  7. You are responsible for your own health and physical condition. You understand that your participation in this programme and fitness testing procedures could result in injury if carried out incorrectly. You are voluntarily participating in Fit Around Life exercise programmes. Having such knowledge you thereby release Fit Around Life (Elizabeth Shingleton) and any other persons directly or indirectly associated with this trainer, from liability for accidental injury, illness or death which you may incur as a result of participating in said programme.
  8. Training may involve you undertaking unsupervised workouts between sessions or classes. In participating in any unsupervised training, you:
    • are doing so at your own risk
    • should ensure you have a suitable training space (a suitable non-slip floor, clear of obstructions, sharp instruments and other people)
    • are responsible for your own safety and that of others around you and should refrain from activities if you have or suspect you may have any injuries, aches, pains or other health concerns
    • Elizabeth Shingleton/Fit Around Life may provide dietary advice, optimal macro counts and recipe ideas, but will not provide prescriptive meal plans. You are responsible for ensuring any meals prepared following nutritional advice take account of any allergies etc. You are encouraged to inform your trainer of any allergies or intolerances.
    • Fit Around Life will not accept liability for any damage or loss to any personal property brought onto its premises.
    • All cancellations must be made to Fit Around Life (Elizabeth Shingleton) by phone, text or email. Fit Around Life reserves the right to charge in full for personal training sessions and/or classes cancelled with less than 24 hours’ notice. Your time slot for any session that is cancelled may be made available to other clients and you will no longer be entitled to that session time.
    • If you do not attend sessions without informing Fit Around Life before the start of the session you will be charged in full for the session and may not be offered the opportunity to move the session. This is deemed a 'no show'.
    • Fit Around Life reserves the right to cancel pre-booked sessions for clients who cancel their sessions on a regular basis. You will be notified of this at least one week in advance of any changes.
    • Any block sessions purchased must be paid in full in advance and are non-refundable.
    • You must conduct yourself in a respectful manner. Any client who acts in an intimidating, abusive, violent or disrespectful manner may be asked to leave with no recourse for refund of monies already paid.
    • Clients are welcome to attend classes and training sessions with their children. The personal trainer is DBS approved and will make every effort to ensure children's safety and wellbeing. However, a child's accompanying adult remains ultimately responsible for their safety and should take into account all relevant risks associated with the training environment and any factors specific to the child (e.g. special requirements or health needs).
    • Fit Around Life reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, clients will be made aware of the revised terms and conditions.

    • When participating in online personal training sessions or classes you:
      1. are doing so at your own risk

Privacy

In accordance with UK data protection legislation (namely the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018), we are required to collect and process personal data lawfully, fairly and in a transparent manner. This notice explains how we do that.

About Us

Fit Around Life (we, us or our) is a trading name of Bespoke by Elizabeth Shingleton, who is a data controller as defined under the UK General Data Protection Regulation and the Data Protection Act 2018. Prior to your first training session and at regular intervals throughout your time with us, we are required to undertake health and lifestyle assessments that will require us to capture information about your health and certain equality characteristics (gender, race etc.). These are considered as special categories of personal data under the current data protection legislation. This information is only collected where you provide explicit consent – if you do not provide this information, it may impact our ability to develop bespoke and personalised services for you.

We will never share your information with a third party without your explicit consent unless we are legally obliged to do so.

How do we collect and store your information, and how long will we keep it for?

The only information we hold about you will be what you tell us; we will not collect personal data about you from any third-party sources unless you provide explicit consent. Your electronic information will be stored in a certified Microsoft OneDrive cloud-based repository which fully encrypts data at both transit and rest (see here https://docs.microsoft.com/en-us/microsoft-365/compliance/encryption?view=o365-worldwide for further information). Access to the repository is restricted via role-based access granted only to authorised business personnel. Other measures are in place to protect your information including access controls, encryptions, anti-virus and anti-malware solutions. Any information collected in paper format (such as your personal fitness plan) transferred to Microsoft OneDrive as soon as feasibly possible and then paper copies destroyed.

We will share information between us via email and/or the client portal via the Fit Around Life website. Our email service is provided by Microsoft 365 and further information about the controls in place to protect your information can be found on Microsoft’s website (https://docs.microsoft.com/en-us/microsoft-365/compliance/email-encryption?view=o365-worldwide).

Our website is provided within the secure encryption HTTPS protocol. All forms and interactive elements contained within our website operate within the secure HTTPS protocol. Your information and data will be processed on receipt at our company using secure business processes and systems, as outlined above.

Our website uses cookies, which are small files which ask permission to be placed on your computer’s hard drive. Once you agree, cookies:

We do not use any third-party affiliate marketing cookies or anything that would be classed as intrusive to your activity on our website. You can choose to accept or decline cookies, however declining them may prevent you from taking full advantage of our website.

When undertaking video consultations and classes, we will use one of the following third-party providers. We will never record a session or consultation without your permission.

When providing online training, we use the Everfit app, who act as our Data Processor in relation to personal data entered into the app. Further privacy information relating to the Everfit app can be found at https://everfit.io/privacy/

We will keep copies of the personal data you provide to us for six years after your final personal training session or online training package expires, in line with The Limitation Act 1980.

Person responsible for data protection

Because of the volume and type of data we process, we are not legally required to appoint a Data Protection Officer. However, we take our data protection responsibilities very seriously and have appointed Jon Shingleton as the person responsible for data protection at Fit Around Life. Jon is a qualified data protection practitioner and holds the British Computer Society’s Data Protection Practitioner certification.
